Student Conduct and Discipline

B. Good Cause: The Student Code of Conduct

As used in this section, good cause includes but is not limited to the following offenses from the Education Code Section 76033 (these offenses, also called the "Student Code of Conduct", are the basis for the administration of the various forms of discipline as later defined):

  1. Continued disruptive behavior, continued willful disobedience, habitual profanity or vulgarity, or the open and persistent defiance of the authority of, or persistent abuse of, College personnel.
  2. Assault, battery, or any threat of force or violence upon a student or College personnel.
  3. Willful misconduct which results in injury or death to a student or College personnel or which results in cutting, defacing or other injury to any real or personal property owned by the District.
  4. Dishonesty, including but not limited to cheating, plagiarism, or knowingly furnishing false information to the College or its officials.
  5. The use, sale, or possession on campus of, or presence on campus under the influence of, any controlled substance prohibited by law.
  6. Willful or persistent smoking in any area where smoking has been prohibited by law or by regulation by the Board of Trustees.
  7. Persistent, serious misconduct where other means of correction have failed to bring about proper conduct.

In addition to the above listed causes from the Education Code, Porterville College also includes the following as good cause for disciplinary action:

  1. Obstruction or disruption of teaching, administration, disciplinary procedures, College activities, or other authorized activities on the College premises.
  2. Unauthorized entry into College facilities or unauthorized use or misuse of College property.
  3. Possession, use or the threat of use, of deadly weapons, explosives, or dangerous chemicals on College property or at College sponsored events without written authorization.
  4. Abuse or unauthorized use of the College’s computer equipment, software, passwords, or any violation of the confidentiality or security of passwords or records including but not limited to student and staff databases, networks, Internet, e-mail, and World Wide Web.
  5. Attempting to do or soliciting or assisting another to do any of the causes for disciplinary action identified above or in the related sections of the Education Code.
